The 2024 National Defense Authorization Act (NDAA) and new regulations have brought important updates for SDVOSB contracting, which enhance opportunities for service-disabled veteran-owned businesses like ours.

Sole-Source Contracting Thresholds

For non-manufacturing contracts, the sole-source award threshold is $5 million for the Department of Veterans Affairs (VA), while for other federal agencies, the threshold remains $4 million. For Department of Defense (DoD) contracts, the sole-source threshold has been increased to $8 million.

SBA Certification Requirement

As of January 1, 2024, Shoulder 2 Shoulder, Inc. (S2S) is proud to hold the required SBA certification as a Service-Disabled Veteran-Owned Small Business (SDVOSB). This certification ensures that we continue to qualify for SDVOSB set-asides and sole-source contracts across federal agencies. With the transition from self-certification to SBA certification, federal agencies are now required to award SDVOSB contracts only to businesses certified through the SBA’s Veteran Certification Program.

By maintaining this certification, S2S is fully compliant with federal procurement regulations and positioned to help agencies meet their SDVOSB contracting goals.

Expanded SDVOSB Contracting Opportunities

The federal government has increased the contracting goal for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) to 5% of all federal contracting dollars, up from the previous 3%. This significant change demonstrates a continued commitment to supporting and expanding opportunities for veteran-owned businesses across federal agencies.

Set Asides and Sole Source Awards

When working with Shoulder 2 Shoulder, Inc. (S2S), a contracting officer can set aside a solicitation exclusively for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) if there is a reasonable expectation that at least two or more SDVOSBs will submit competitive offers, and that the contract can be awarded at a fair market price. There is no dollar limit for SDVOSB set-asides, making it an effective way for agencies to support veteran-owned businesses while meeting their mission needs.

If only one offer is received from an SDVOSB like S2S, the contracting officer can still award the contract, provided the offer meets fair market price standards. This flexibility allows agencies to confidently engage with S2S for mission-critical services, ensuring that procurement processes are both efficient and fully compliant with federal regulations.

Sole-Source Awards for SDVOSBs

Sole-source SDVOSB contracts can be awarded if only one qualified SDVOSB is determined to be available to perform the contract. The current thresholds for sole-source awards are $4 million for all other NAICS codes (non-manufacturing contracts). For DoD contracts, the sole-source threshold is $8 million.

Eligibility

All federal agencies are required to comply with Executive Order 13360, which mandates directing at least 5% of contracting dollars to SDVOSBs, an increase from the prior 3% requirement per the 2024 National Defense Authorization Act (NDAA).

By understanding and leveraging set-asides and sole-source awards, federal agencies can streamline contracting while supporting veteran-owned businesses in achieving their mission objectives.
